1. OVERVIEW

This Legal Notice describes the general terms that apply to Smidhus, its website, and its current products, including Rephora and Smidhus-SDD-Harness.

Smidhus operates as an independent software foundry focused on building software products, developer tools, backend systems, automation workflows, and digital platforms.

By accessing Smidhus websites, using Smidhus products, or interacting with Smidhus tools, users agree to follow this Legal Notice and any product-specific terms that may apply.

2. PRODUCTS COVERED

This notice applies to:

  • >Rephora, a learning platform for structured study sessions, concept memorization, quizzes, flashcards, progress tracking, and AI-assisted feedback.
  • >Smidhus-SDD-Harness, an open-source DevTool CLI for Spec-Driven Development workflows that integrates with opencode and user-configured AI providers.

Additional terms may apply to future Smidhus products, paid features, private builds, or client-specific work.

3. INTELLECTUAL PROPERTY

The Smidhus name, visual identity, brand assets, character artwork, interface style, written content, product concepts, and original website materials are owned by Smidhus unless otherwise stated.

Users may not copy, reproduce, modify, redistribute, or use Smidhus brand assets without prior written permission, except where permitted by applicable law or an explicit license.

Product names, logos, and third-party references belong to their respective owners.

4. OPEN-SOURCE COMPONENTS

Some Smidhus products or sub-products may be released as open-source software.

For open-source projects, the applicable license in the project's repository controls how the software may be used, modified, copied, or distributed.

If there is a conflict between this Legal Notice and the license file of an open-source Smidhus project, the open-source license applies to the open-source code covered by that license.

Smidhus brand assets, website design, character artwork, and commercial identity are not automatically included in open-source software licenses unless explicitly stated.

5. SMIDHUS-SDD-HARNESS

Smidhus-SDD-Harness is a DevTool CLI designed to help users structure Spec-Driven Development workflows.

The tool may include templates, agents, skills, validation flows, documentation helpers, and development orchestration patterns.

Users are responsible for:

  • >Reviewing generated outputs before using them.
  • >Validating code, documentation, infrastructure changes, and design decisions.
  • >Protecting credentials, API keys, tokens, and private project data.
  • >Understanding the terms of any AI provider connected through opencode.
  • >Ensuring that generated or assisted work complies with project, company, and legal requirements.

Smidhus-SDD-Harness does not replace engineering judgment, security review, testing, or professional validation.

6. REPHORA

Rephora is a learning and study product.

Rephora may provide study organization, memorization workflows, progress tracking, quizzes, flashcards, and AI-assisted feedback.

Rephora is intended to support learning. It does not guarantee academic results, professional certification, employment outcomes, or mastery of any subject.

AI-assisted feedback may be useful, incomplete, inaccurate, or context-dependent. Users should review feedback critically and use it as a learning aid, not as an authoritative source.

7. USER RESPONSIBILITIES

Users agree not to use Smidhus products to:

  • >Violate applicable laws or regulations.
  • >Infringe intellectual property rights.
  • >Upload, generate, or distribute harmful, abusive, illegal, or deceptive content.
  • >Attempt to bypass security controls.
  • >Reverse engineer private systems where not permitted.
  • >Abuse APIs, infrastructure, queues, authentication systems, or background processing.
  • >Store credentials, secrets, or highly sensitive data in fields not designed for that purpose.

Users are responsible for the accuracy, legality, and appropriateness of the content they create, store, process, or submit through Smidhus products.

8. THIRD-PARTY SERVICES

Smidhus products may rely on third-party services, including AWS infrastructure and user-configured AI providers.

Third-party services are governed by their own terms, policies, pricing, limits, and availability.

Smidhus is not responsible for outages, pricing changes, model behavior, data handling, or policy changes from third-party services outside Smidhus control.

9. SERVICE AVAILABILITY

Smidhus aims to build reliable and maintainable software products.

However, products may change, experience downtime, include bugs, or be discontinued.

Beta, experimental, open-source, or early-access products may change without prior notice.

Smidhus may update, restrict, suspend, or remove features when needed for security, maintenance, product direction, legal compliance, or operational reasons.

10. NO WARRANTY

Smidhus products are provided on an "as is" and "as available" basis unless a separate written agreement says otherwise.

Smidhus does not guarantee that:

  • >Products will be uninterrupted or error-free.
  • >AI-assisted outputs will always be accurate.
  • >Study results will meet user expectations.
  • >Developer tools will produce production-ready results without review.
  • >Third-party integrations will remain available or unchanged.

Users should test, verify, and review outputs before relying on them.

11. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, Smidhus is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from the use of Smidhus products.

This includes, without limitation, loss of data, loss of profits, service interruptions, incorrect AI outputs, failed deployments, learning outcomes, third-party service behavior, or user misconfiguration.

Nothing in this notice limits liability where such limitation is not allowed by law.

12. ACCOUNT DELETION

For products that require accounts, such as Rephora, users may request account deletion.

Smidhus may apply a 10-day soft-delete grace period before permanent deletion. During this period, the user may be able to restore the account or request a data report when available.

After the grace period, Smidhus may remove related records from application databases and authentication systems, unless retention is required for legal, security, dispute resolution, or operational reasons.

13. FEEDBACK AND PRODUCT IDEAS

If users send feedback, suggestions, ideas, bug reports, or feature requests to Smidhus, they allow Smidhus to use that feedback to improve its products without obligation to provide compensation, unless otherwise agreed in writing.

Users should not submit confidential information unless a separate written agreement is in place.

14. CHANGES TO THIS NOTICE

Smidhus may update this Legal Notice as products, operations, or legal requirements change.

When material changes are made, the lastUpdated date will be updated. Continued use of Smidhus products after changes means the user accepts the updated notice.
